Zero Surprise Deductions
Plans are prepaid for fixed durations. We will never auto-debit your MoMo wallet or bank card without express action.
Complete IP Ownership
You own all rights to your garment designs, fabric sketches, client measurements, and brand assets.
Anti-Spam & Ethics
Outbound SMS and WhatsApp tools may only be dispatched to genuine clients who placed an order with your business.
1. Acceptance of Terms & Eligibility
By registering an account, accessing the Ntoma management dashboard, or publishing a storefront catalog, you (“Merchant”, “User”, or “You”) agree to be legally bound by these Terms of Service. You must be at least 18 years old or possess legal business authority under Ghanaian or applicable national law to enter into binding agreements.
2. Subscription Billing & Zero Automatic Deductions
Ntoma operates on an artisan-first, fixed-duration prepaid billing structure:
- Fixed Durations: Subscriptions are purchased in upfront periods (e.g. 30 days, 90 days, or 365 days) via Mobile Money (MTN MoMo, Telecel Cash, AT Money) or Card.
- No Involuntary Debits: Unlike foreign software that automatically charges credit cards each month, Ntoma never initiates automated overdrafts or withdrawals from your mobile money account.
- Grace Period: If your plan expires, your workspace enters a read-only grace period. Your customer records and order history are securely preserved, giving you ample time to renew without disruption.
3. Account Security & Team Workspace Seats
You are responsible for maintaining the confidentiality of your login credentials. If you invite staff members or apprentices to your workspace via Ntoma Team Seats, you remain responsible for the actions performed by those seats within your account.
4. Acceptable Use, SMS & WhatsApp Communications
Ntoma includes integrated SMS dispatch (via Arkesel/Hubtel) and one-click WhatsApp client communications. You agree that:
• SMS and WhatsApp links must only be used for legitimate customer order updates (e.g. fitting reminders, balance notifications, invoice receipts).
• You will not use the platform to send unsolicited marketing blasts (cold spam) to arbitrary telephone numbers.
• Telephony toll fraud, spoofing sender IDs, or circumventing verification controls will result in immediate termination without refund.
5. Intellectual Property & Data Ownership
You retain complete, exclusive ownership of your business name, logos, garment photographs, client measurement archives, and custom specifications. Ntoma grants you a non-exclusive, revocable license to utilize the platform during your active subscription. You can export your data at any time in Excel (.xlsx) and PDF formats.
6. Service Availability & Limitation of Liability
Ntoma is provided on an “as is” and “as available” basis. While we strive for 99.9% uptime and low-bandwidth optimization for West African cellular networks, we are not liable for temporary telecommunications carrier blackouts or external payment gateway disruptions. In no event shall Ntoma's aggregate liability exceed the total subscription fees paid by you in the preceding three (3) months.
7. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising from these Terms shall first be addressed through good-faith mediation in Accra, Ghana.
